PAWS AND PILATES LIABILITY WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND NO-REFUND ACKNOWLEDGMENT
This Liability Waiver, Assumption of Risk, Release of Liability, and No-Refund Acknowledgment ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Paws and Pilates, including its owners, employees, contractors, instructors, agents, volunteers, affiliates, and representatives (collectively, "Paws and Pilates"). By signing below, Participant acknowledges and agrees to the following terms as a condition of participating in classes, sessions, events, use of the premises, or any related activities offered by Paws and Pilates (collectively, the "Activities").
1. Assumption of Risk. Participant understands and acknowledges that the Activities may involve physical exertion and inherent risks, including but not limited to slips, trips, falls, muscle strains, sprains, aggravation of pre-existing conditions, collisions with people, animals, or equipment, and other injuries or losses that may occur during or after participation. Participant voluntarily chooses to participate in the Activities and knowingly assumes all risks, known and unknown, foreseeable and unforeseeable, associated with participation.
2. Release of Liability. To the fullest extent permitted by applicable law, Participant releases, waives, and discharges Paws and Pilates from claims, demands, causes of action, damages, costs, or expenses arising out of or related to Participant’s participation in the Activities, including claims for personal injury, illness, property damage, or other loss. Participant understands that this release is intended to apply to ordinary negligence to the extent permitted by law and does not apply to any liability that cannot legally be waived.
3. Personal Property; Lost or Damaged Items. Participant is solely responsible for personal belongings brought onto the premises or to any Activity. Paws and Pilates is not responsible for lost, stolen, or damaged personal property, including without limitation phones, jewelry, bags, clothing, accessories, fitness gear, or other personal items, whether such loss or damage occurs before, during, or after the Activities.
4. Clothing and Apparel Damage. Participant understands that exercise and movement-based activities may result in ordinary wear and tear, stretching, snagging, tearing, or other damage to clothing, footwear, or accessories. Participant accepts this risk and agrees that Paws and Pilates is not responsible for ripped clothing or other damage to apparel or accessories occurring in connection with the Activities, except where prohibited by law.
5. No Refunds for Dissatisfaction. Participant understands and agrees that, unless otherwise required by law or expressly stated in a separate written policy of Paws and Pilates, fees paid for classes, sessions, memberships, packages, events, or other services are non-refundable based on dissatisfaction with the experience, format, instruction, results, preferences, or other subjective reasons.
6. Participant Representations. Participant represents that they are physically able to participate, will stop participation if they feel pain, dizziness, or other concern, and will inform Paws and Pilates of any condition that may affect safe participation. Participant understands that Paws and Pilates does not provide medical advice and that Participant is responsible for consulting a medical professional if needed.
7. Severability and Acknowledgment. If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law. Participant acknowledges that they have read this Agreement carefully, understand its contents, understand that they are giving up certain legal rights, and sign it voluntarily.

Hereinafter referred to as the "Breeder.".
1. Services Provided: The Breeder agrees to provide Paws and Pilates with the service of allowing their puppies to participate in the Studio's Pilates class to take place on the date _____________________
2. Compensation: The Studio agrees to compensate the Breeder at a rate of $1000 total for Saturday and Sunday participation. A $250.00 deposit will be made by Paws and Pilates upon signing of this agreement.
3. Itinerary: A detailed itinerary for the date of the class will be communicated to the Breeder approximately 7 days prior to the scheduled class dates. As well as a 24 hour reminder will be sent to breeder prior to the scheduled class dates. The breeder will provide a photo to Paws and Pilates of the puppies Stud or Dam at least 2 weeks prior to scheduled classes.
4. Commitment and Cancellation: Once the Breeder commits to a date, it cannot be canceled under any circumstances. Any last-minute cancellations will result in Paws and Pilates refraining from using the Breeder's services in the future. A refund of deposit and forfeiture of potential funds. Paws and Pilates reserves the right to cancel any future classes with breeder for any of the following reasons
a. Puppies are found to be in poor conditions or treated poorly (example being: residing or being held in feces urine or other bodily fluids.)
b. Breeder fails to provide adequate nutrition to puppies (Paws and Pilates will cover and accrue the cost of one bag of food of breeders choice. No more than 12lbs per breeder per weekend of the dates the Breeder attends class
c. Puppies are found to be purchased by a third party seller otherwise known as puppy mills. ( A practice that is unacceptable to the Paws and Pilates foundation.)
d. Puppies show up sick on multiple occasions over the course of multiple litters
e. Breeders are found to be unable to provide proper documentation and proof of welfare of both puppies as well as well fare of puppies parentage
5. Insurance: Paws and Pilates shall maintain insurance coverage applicable to the class weekend for activities conducted at the studio. Such coverage is intended to apply to the participating puppies while they are present at the Studio and taking part in the scheduled class activities, subject to the terms, conditions, limitations, and exclusions of the applicable insurance policy. The Breeder remains responsible for providing accurate health and vaccination information and for ensuring that each puppy is fit to participate.
6. Payment: Payment will be made via electronic transfer (Cash-app, Venmo, Paypal, Bank Transfer) Upon pick up of puppies at the end of Sunday. Payout timeline is subject to bank processing times
7. Puppy Drop-off: The Breeder shall drop off all agreed upon puppies no later than 30 minutes before the scheduled class start time to allow adequate time for check-in, setup, and preparation. (If puppy selection needs to be changed Breeder must notify Paws and Pilates 72 hour notice to allow for marketing changes)
8. Cleanliness Requirements:
1. Please arrive with all puppies freshly bathed and clean.
2. Bring any specialty cleaning supplies that may be needed for the puppies during the class weekend.
3. Paws and Pilates has the following cleaning products available for the class. Dependent on Breeders preference.
o Kennelsol
o Odoban
o Rescue
o Dog Waste Bags
o Puppy Cleaning Wipes (Unscented)
9. Items to Bring: The Breeder shall bring items that help the puppies feel comfortable and familiar in their surroundings, including blankets, food bowls, and special toys, as applicable.
10. Handling Schedule and Rest Periods: Each class day shall consist of 45 minutes of class time, 30 minutes of puppy play, and 30 minutes for turnover.
The puppies shall be handled by customers only in 30-minute increments during puppy play , for a maximum total of 2.5 hours of handling per day, Puppies will be separated from and monitored by handler during class and turnover in order to prevent overstimulation and avoid creating negative associations with handling.
11. Outdoor Puppies will not be allowed outside nor will they have access to open doors windows etc. Puppies will have potty pads provided by Paws and Pilates. The only time Puppies with leave the studio is upon Breeder pick up and drop off. Puppies will be transported in an enclosed stroller to ensure safety.
12. Sales and Referral Fee: While sales are not actively promoted during classes, participants may inquire about purchasing or adopting puppies. The Studio is happy to connect participants with the Breeder or shelter, however no puppies are allowed to be sold by or through Paws and Pilates. All sales of puppies are exclusively separated from Paws and Pilates and only occur between Breeder and Purchaser.
